examined stated that one night during his absence from his hut
a second party by the order of a third brought the Tobacco and
delivered it to the fourth of the parties accused.
The 1st and 2nd. Witnesses deposed that upon their appre-
hending the prisoner upon the information they had received,
he produced from his hut the Tobacco in question and delivered
it to them, and they stated that the 2nd. and 3rd. of the parties
accused are cognizant of the matter.
On persusal of the proceedings held in the case, being of
opinion that the charge of having received and secured smuggled
Tobacco had been established against the prisoner and as tbe 1st
and 2nd. Witnesses prove that the prisoner produced from
his hut and delivered to them a large quantity of Tobacco, I
accordingly on the 5th. Instant, forwarded to the Sub-Criminal
Court of Calicut the prisoner and Witnesses with the record of
the case and one Palam of Tobacco as a sample and the usual
report; copies of the report in question and of the other pro-
ceedings specified in the enclosed list are herewith transmitted.
I have issued a Takeed to the Amsham and am adopting other
measures for the apprehension of the 3rd. Defendant who
brought the Tobacco in question (to the house of the 1st.
Defendant) and of the 2nd and 4th Defendants, the former of
whom appears to have assisted the 3rd. Defendant.
Immediately on their apprehension I will examine them and al-
so the Mookhiyastars in regard to their having made a favourable
report regarding the prisoner and will inform you of the same.
